There is now less than one year to go until the BA data breach compensation deadline expires. This may sound like a long time left to claim, but it may come around quicker than you expect.
And if there is one thing we can tell you as expert Group Action Lawyers, it is this: people will more than likely miss the deadline. It is no crystal ball that tells us this; it is simply our vast knowledge and experience, as we have seen so many people miss deadlines for previous actions in the past.
Do not be one of those people who put it off and put it off. It can be beneficial joining sooner rather than later, and the longer you leave it, the greater the risk can be
The BA data breach compensation deadline is currently set by the Court for 17th January 2021. This means that we are now less than a year away from the expiration date.
It may feel like you have plenty of time to join, but there is no reason as to why you should delay joining now. There is work to be done and information to gather, as well as evidence to collate. You are far safer having everything ready on your case – all the boxes ticked – well in advance of the deadline.
If it comes to a point where your case is not prepared, there may be nothing that we can do.
There could also be key developments that may happen between now and the deadline as well. Joining the BA Group Action now means you can be in the loop as to what is going on, and you may also be able to benefit from any positive steps that happen along the way.
We expect that there will be people who will miss the formal BA data breach compensation deadline to join the GLO (Group Litigation Order).
We have – and still are – involved in a number of group action compensation cases where a deadline for joining has been set by the court. In each one we have been involved in, we have been contacted by people who missed the deadline, and we have had to turn people away.
Some of these people have approached us years after the deadline has passed, and many of them say that they simply did not know about the action and the deadline. Whether that is the case or not is usually irrelevant. If you miss the deadline, you will normally need to ask for special permission from the court to join the action late. In our experience, this is not something that is allowed for those who simply did not know.
In a previous action we were involved with, a different law firm missed the deadline due to (we understand) some funding issues they were having. The judge refused their request to join late, and that was that. This should also act as a warning about making sure you instruct the right law firm to represent you for the case as well.
