Data breach group actions account for most of the group and multi-party actions that we’re involved in. Around three-quarters of the over 40 separate actions we’re representing people for involve some form of leak, breach or hack.
As such, this area of law is a particular specialty of ours.
When we are asked for help, or when we spot a potential data action, our lawyers and legal team act fast in order to see if we can help people. Although organisations can receive substantial fines form the ICO (Information Commissioner’s Office), this money is not used for compensation. For victims to be able to receive justice for what they have had to suffer, we can represent them on a No Win, No Fee basis and launch our own separate legal action.
Data breach group actions are incredibly important for the victims of leaks, breaches and hacks to be able to access the justice that they deserve. The misuse or the loss of control of personal information can cause considerable distress for victims, as well as financial losses in some cases.
These are both things that people can be entitled to claim damages for.
Enforcement action from regulators like the ICO can act as a punishment and a deterrent, but this doesn’t directly affect the victims. That’s why we launch our own separate legal actions for victims who can then come together and form a group where there are several victims affected. We can then pursue a group compensation claim as the fastest and most efficient method of ensuring that victims can receive damages for being affected by a data breach event.
Both data breach compensation and group actions / multi-party litigations are quite specialist areas of law. It’s therefore important to make sure that you speak to an expert law firm like us to be able to access the best legal advice and representation possible.
Our data breach compensation experience stems back to early breaches of the last few years, where the number of incidents has increased massively. From the TalkTalk incident to the 2015 56 Dean Street leak, our legal team is involved in most (if not all) the big names ones.
In terms of group actions, we’ve been fighting for justice in actions dating back to 2011 like the PIP Breast Implant scandal, and we were appointed to the Steering Committee for the VW Emissions Action; understood to be the largest action the UK has ever seen. We have also recently been appointed to the Steering Committee for the BA Group Action as well.
For our clients, this means that our experience speaks for itself.
You can speak to our team today to find out if we can assist you with a claim for compensation. You may be able to join one of our existing data breach group actions, or if it’s a new case we’re not working on, we’re happy to advise you on an entirely free and no-obligation basis.
If a new case is one we can then take forward, we may be able to offer you No Win, No Fee representation right away.
