What are group medical negligence actions
Sometimes, there can be large-scale events in the healthcare industry that impact many people. If this is the case, medical negligence actions for compensation can be launched, and they can end up being either a Group Action or a Multi-Party Action.
In terms of the way that we work, we typically classify Group Actions (also known as Class Actions) where multiple people are claiming together and may end up on joint proceedings. This could arise from the discovery of a major incident where many people are affected, such as the infamous PIP Breast Implants scandal from a few years ago. Whilst these were actually product liability cases, they were medical matters that pertained to private cosmetic surgery for breast implants.
Our firm has recovered over £1.3m in damages for victims of the PIP breast Implant Scandal. We are no longer able to accept new cases, but some remain ongoing, primarily in the French courts.
Multi-Party actions are what we refer to as cases where many people are affected by the same or similar issue but do not generally claim together. Easy examples are the Vaginal/Pelvic Mesh and Hernia Mesh matters, where we need to pursue each case on its own merits. Liability can be different in different cases, and there are too few common issues in our view for them all to form into a single group legal case.
