Johnson & Johnson pelvic mesh settlements

News of the Johnson & Johnson pelvic mesh settlements in Scotland are welcome here at the Group Action Lawyers as the wider fight for justice continues.

Settlements have now been achieved for thousands of people worldwide, and millions of pounds in damages have been paid out. But the battle for many women rages on, and we represent people for cases here in England and Wales.

Here, we will briefly cover the settlement in Scotland and how this affects vaginal mesh claimants in the rest of the UK.

About the Johnson & Johnson pelvic mesh settlements in Scotland

The Johnson & Johnson pelvic mesh settlements in Scotland resulted in subsidiary company Ethicon agreeing to pay out a reported £50m in damages to hundreds of women. It has been reported that representatives flew to Edinburgh prior to the coronavirus lockdown being enforced  where the terms of the agreement were made.

The settlements have been achieved without any admission of liability on behalf of Ethicon or J & J. In group and multi-party cases like this, settlements without admissions of liability are common. For example, we have recovered over £1.3m in damages (and counting) for victims of the infamous PIP Breast Implant Scandal, and most of the Defendants have never accepted liability. Instead, settlements have been made without prejudice to liability, and many have been subject to confidentiality agreements.

This is positive news and we are glad that women in Scotland will be able to benefit from the settlements and bring their fights for justice to a close.

Does this affect the rest of the UK?

The Scottish Johnson & Johnson pelvic mesh settlements will not have a direct legal impact on claims that we represent people for in England and Wales. England and Wales share a jurisdiction, but Scotland and its own legal jurisdiction, as does Northern Ireland. This means that we are unable to rely upon the settlements to directly help us here as the jurisdictions are separate.

That being said, there are many similarities between the jurisdictions, and news of the settlement is welcome. We continue to represent several women suffering from severe and permanent problems and complications arising from the use of vaginal mesh implants, and we remain hopeful of positive conclusions. This includes Ethicon and Johnson & Johnson pelvic mesh settlements here too.

Legal representation in England a Wales

We can represent victims claiming compensation for vaginal mesh issues here in England and Wales on a No Win, No Fee basis.

If you have yet to start a claim, we recommend that you do so immediately. We have had to reject a number of recent enquirers because they were out of time for claiming, and the rules for these kinds of cases can be strict. There can also be more than one deadline and it is not as clear as an accident claim where you can usually run the date from the date of an incident. We recommend that you seek our advice as urgently as you can.

Our advice is available now for you on a free and no-obligation basis. There is nothing to lose in getting in touch to find out if we can offer you a No Win, No Fee agreement.
