At The Group Action Lawyers, we know all too well how the collective force of a group action can be powerful in holding companies to account.

A recap of the data breach

In March 2020, it was revealed that Virgin Media had left mostly customer data exposed in an unsecure database for a lengthy ten-month period. This was due to the fact the database was reportedly “incorrectly configured” by an employee.

Of further concern, the error was not identified until an external security researcher came across the vulnerability.

The data is understood to have been accessed at least once by an unauthorised third-party. Data comprised included phone numbers, email addresses and home addresses. With such information, cybercriminals could engage in cyberattacks and fraud attempts directed at the victims. This could include tactics such as phishing scams, leaving affected customers in a position of significant vulnerability.

As a result, a group action has been launched, and this may transform into an official Virgin Media data breach class action with the court in due course. This can help to bring claimants together to then be a part of a single collective fight for justice.

We have already taken on thousands of claimants and we are certain that the numbers will continue to grow, given the huge figure of affected victims.

Compensation claims in the Virgin Media data breach class action

You may be thinking about what reasons or evidence you need to have to make a claim and be a part of any Virgin Media data breach class action that forms. We can assure you that your case can be quite simple. Victims could be eligible to claim for their involvement in the data breach alone, meaning that you may only need your notification from Virgin Media that your data was affected.

Further to this, compensation sums could also cover the categories of General Damages, compensating victims for any distress or psychological injury suffered, and Special Damages, which can act to reimburse victims for expenses and losses that they may have suffered as a result of the breach. This could apply if someone has been affected by fraud, as one example.

The compensation amounts can, of course, vary depending on our valuation and/or the severity of any damage suffered. We can determine this through our knowledge of case law and our experience of data breach claims.

As it stands, we estimate that average compensation amounts could be in the region of £5,000 for eligible claimants.
