If you have received a recall notification for your vehicle, you could be entitled to make a claim for Mercedes emissions compensation. If the recall is in relation to technical measures, software updates, engine management matters, or anything linked to emissions, you may have a case.
You may be aware that Volkswagen has been found to have used so-called “defeat devices” to cheat emissions testing regimes. Although they dispute the legal action in the UK, they have settled matters elsewhere and have been found guilty in other jurisdictions. It is also suspected that software used by Daimler may fall into the category of a “defeat device”. They are denying any wrongdoing, but the German regulator the KBA (German Federal Motor Transport Authority) concluded in hearings in Germany that they believe some vehicles are not complying with regulations. What we now need to establish is why.
If it is established that software has been used that amounts to a “defeat device”, owners could be entitled to make a claim for compensation. Claims could be based on any impact to the value of the vehicle, or regulations that can allow owners to receive a percentage of the purchase price of their vehicle.
AdBlue emissions irregularities
Mercedes emissions compensation cases may also be based on alleged irregularities concerning the use of their AdBlue technology.
AdBlue is used for many diesel models and is designed to reduce harmful NOx emissions that can be damaging to human health and to the environment. If it is found that their AdBlue vehicles are still not complying with the regulations for emissions reduction, owners could be entitled to compensation. Again, we will need to establish why this is the case and whether the law has been broken.
Again, Daimler disputes that they have done anything wrong. Given the seriousness of these issues, we are investigating claims in any event. In the same way that we took forward thousands of claims for VW owners on a No Win, No Fee basis, we are also prepared to work in this way for Mercedes diesel owners also.
